Composition

The Constitutional Court shall be composed of nine (9) judges who shall be distinguished jurists of the highest moral character, with not less than ten (10) years of relevant professional experience. Other relevant qualifications shall be provided by law.Principles of gender equality shall be respected.

Judges shall be appointed by the President of the Republic of Kosovo upon the proposal of the Assembly and shall serve for a non-renewable mandate of nine (9) years. 3. The decision to propose seven (7) judges requires a two thirds (2/3) majority of the deputies of the Assembly present and voting. The decision on the proposals of the other two (2) judges shall require the majority vote of the deputies of the Assembly present and voting, but only upon the consent of the majority of the deputies of the Assembly holding seats reserved or guaranteed for representatives of the Communities not in the majority in Kosovo.

The mandate of a judge of the Constitutional Court shall end upon expiry of regular period for which he/she is elected. The mandate of a judge of the Constitutional Court shall end prior to the expiry of regular period for which he/she is elected in case of:

  • resignation;
  • death;
  • permanent loss of ability to act as determined by the competent court;
  • illness or any other health problem, which makes it impossible for him/her to exercise his/her functions as a judge of the Constitutional Court;
  • dismissal pursuant to Article 118 of the Constitution
