On 2 September 2013, the Constitutional Court of the Republic of Kosovo decided case KO 95/13 concerning the request to assess the constitutionality of the Law on Ratification of the First International Agreement of Principles Governing the Normalization of Relations between the Republic of Kosovo and the Republic of Serbia and the Implementation Plan of this agreement, Law No 04/L-199, as regards its substance and the procedure followed for its adoption.
The referral was submitted to the Court on 4 July 2013 by Mr Visar Ymeri and 11 other deputies of the Assembly of the Republic of Kosovo.
The Constitutional Court decided the following:
1. Unanimously, to declare the Referral admissible;
2. Unanimously, to declare that the procedure followed for the adoption of the Law on Ratification of the First International Agreement of Principles Governing the Normalization of Relations between the Republic of Kosovo and the Republic of Serbia and the Implementation Plan of this agreement, No. 04/L-199, is compatible with the Constitution of the Republic of Kosovo.
3. By majority, to reject the Applicants’ request to review the constitutionality of the First International Agreement of Principles Governing the Normalization of Relations between the Republic of Kosovo and the Republic of Serbia and the Implementation Plan of this agreement as outside the jurisdiction ratione materiae of the Constitutional Court.
The decision of the Court will be served in due course on the parties, posted on the website of the Court and published in the Official Gazette of the Republic of Kosovo.
