The Constitutional Court at is session held on 14 December 2010 deliberated on the Referral of Dr Jakup Krasniqi, the Acting President of Kosovo.
Dr Krasniqi made a Referral to the Court posing two questions which the Constitutional Court unanimously answers as follows:

  • There is no prohibition on an Acting President of Kosovo exercising the party political functions mentioned in Article 88.2 of the Constitution.
  • The temporary holding and exercise of the functions of President of the Republic of Kosovo and at the same time exercising the position of the Secretary-General of PDK is not incompatible with the Constitution.

The full Judgment of the Court will be published in due course.

 

The Constitutional Court of Kosovo was established in January 2009.

With its authority to review legislation and individual complaints of rights violations, the Court is the ultimate check on legislative and executive power in Kosovo and the final arbiter of the meaning of constitutional provisions enshrining human rights and freedoms.
