Training on the right to privacy

The constitutional-legal advisers of the Constitutional Court of the Republic of Kosovo participated in a two-day training on the right to privacy, organized with the support of the Council of Europe Office in Pristina, on 3 and 4 June 2024, at the “Sirius Hotel” in Prishtina.

The main topics on the first day of the training were the right to private and family life, the concept of “negative and positive obligations” of the state according to Article 8 (Right to respect for private and family life) of the European Convention on Human Rights, data protection issues and trends in our country, as well as the surveillance of telecommunications and digital communications in a criminal context.

On the second day of the training, the focus of the discussion was the case-law of the European Court of Human Rights regarding data collection (including covert surveillance), their storage and disclosure by state authorities, the standards for the protection of data and access to personal information, including “health data”, as well as the use of personal data as “evidence” in criminal proceedings.

Organized as a continuation of professional training for advisers of the Constitutional Court within the frame of the project of the Council of Europe Office in Prishtina “Support for the Constitutional Court in Applying and Disseminating European Human Rights Standards”, the two-day training was held with international experts in the field, engaged with the support of the Council of Europe.
