KI33/18, Applicants: Nadije Kadriu, Gëzim Kadriu, and Albulena Kadriu, Constitutional review of Judgment Rev. no. 327/2015 of the Supreme Court of the Republic of Kosovo, of 25 November 2015

KI33/17, Decision on inadmissibility approved on 3 July 2017 and published on 9 November 2018

Key words: individual referral, civil procedure, manifestly ill-founded referral, inadmissible referral

The Applicants challenged the constitutionality of Judgment Rev. no. 327/2015 of the Supreme Court, of 25 November 2015. They alleged that the decisions of the regular courts had violated their rights guaranteed by the Constitution. The Applicants made no reference to any concrete constitutional provision.

Having reviewed the referral in entirety, the Court concluded that the Applicants had not submitted their referral within the time limit of four (4) months, as stipulated by Article 49 of the Law on the Constitutional Court and Rule 39 (c) of the Rules of Procedure of the Court. The referral was, therefore, declared inadmissible as having been filed out of time.
