On 16 October 2009 the Constitutional Court of Kosovo, by majority of votes, rendered a decision for the imposition of a Provisional Measure on the application of article 20.1 of the Law on Radio Television of Kosovo, until the decision on the merits of the case KI. 11/09, Tomë Krasniqi versus Radio Television of Kosovo et al.

The decision for the imposition of the Provisional Measure has been reached after a hearing, held on 6 October 2009, and the deliberation of the judges, held on 12 and 13 October 2009.

According to this decision, it is recommended to the Assembly of the Republic of Kosovo to review article 20.1 of the Law on Radio and Television of Kosovo, and the practices based on it, not later than 1 December 2009. At the same time, the Constitutional Court has determined that the decision on the merits of this case will be rendered after 1 December 2009.

The decision for the imposition of the Provisional Measure is based on article 116 of the Constitution of Kosovo, article 27 of the Law on Constitutional Court of Kosovo and articles 52 and 59 of the Rules of Procedure of the Constitutional Court.
