Concerning Case KO 29/11 “Sabri Hamiti and other Deputies”, “Constitutional Review of the Decision of the Assembly of the Republic of Kosovo, No. 04-V-04, concerning the election of the President of the Republic of Kosovo, dated 22 February 2011.”

On 28 March 2011, the Constitutional Court of the Republic of Kosovo reviewed and voted on Case KO 29/11, “Sabri Hamiti and other Deputies”, “Constitutional Review of the Decision of the Assembly of the Republic of Kosovo, No. 04-V-04, concerning the election of the President of the Republic of Kosovo, dated 22 February 2011.”

The Constitutional Court, unanimously, declared the Referral Admissible, and, by majority vote, with to judges dissenting, declared the Decision of the Assembly of the Republic of Kosovo, No. 04-V-04, concerning the election of the President of the Republic of Kosovo, dated 22 February 2011, unconstitutional, since it is contrary to the requirements of Article 86 of the Constitution of the Republic of Kosovo and the democratic principles enshrined therein.

The full text of the Judgment will be delivered to the parties in due course.

The Constitutional Court of Kosovo was established in January 2009.

With its authority to review legislation and individual complaints of rights violations, the Court is the ultimate check on legislative and executive power in Kosovo and the final arbiter of the meaning of constitutional provisions enshrining human rights and freedoms.
