On 24 February 2021, the Applicant submitted the Referral by mail to the Constitutional Court of the Republic of Kosovo requesting a constitutional review of the Judgment of the Appellate Panel of the Special Chamber of the Supreme Court, considering that it violates the constitutional rights guaranteed by Article 24 [Equality before the Law], Article 31 [Right to Fair and Impartial Trial], Article 46 [Protection of Property] of the Constitution, as well as Article 6 (Right to a fair trial) and Article 1 of Protocol No. 1 [Protection of property] of the ECHR.
Having examined the case file, the Court concluded that the challenged judgment was served on the Applicant on 7 October 2020, on the basis of which it results that the Referral was submitted to the Court out of the 4-month deadline as provided by Law and the Rules of Procedure.
Consequently, the Court rejected the Applicant’s Referral as being submitted out of the time limit.
