The Applicant filed a referral alleging alleges that due to the lack of adequate actions by the Kosovo Police and Municipal Public Prosecutor’s Office in Prishtina in criminal prosecution of persons who assaulted and beat his minor son, although these persons were known to the Police, his constitutional rights, such as prohibition of torture, cruel, inhuman and humiliating treatment were violated, The Constitutional Court decided to reject the applicant’s referral as inadmissible, thereby reasoning that the Applicant had not raised such an issue during the preliminary proceedings, and according to the findings of the Court, authorities had made their best efforts and pursued relevant procedures in identifying the criminal offence, and bringing perpetrators to justice
