The submitted matter concerns the contested ownership of an apartment in the neighbourhood Ortakoll in Prizren, which was initially given to Mehmet Karaxhiu (Applicant’s father) through the contract for the use of the apartment.

The Referral was submitted by Valton Karaxhiu who states that he represents himself and alleges to represent L.B and A.B., from Prizren. The Court had requested from the alleged representative to submit to the Court the power of attorney for representation in the proceedings before the Court.

The Court notes that, apart from his general and abstract Referral, the Applicant did not submit to the Court the requested information and documents of the challenged act, although the Court requested this from him twice.

The Court decided that the Referral does not meet the procedural requirements for further review as provided for in Rule 35 of the Rules of Procedure. Since the Applicant did not clarify the concrete act which he challenges before the Court, did not submit the requested necessary documents, and did not submit a valid power of attorney to the Court regarding the allegation on representation of L.B. and A.B., the Referral is summarily rejected, in accordance with Rule 35 (5) of the Rules of Procedure.
